1. Acceptance of Terms

By accessing or using BigBigBite ("Platform", "we", "us", or "our") at https://bigbigbite.com, you agree to be bound by these Terms of Service and all applicable federal and Florida state laws. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

BigBigBite is an online food ordering platform that connects customers with local restaurants operating in Florida. We facilitate order placement and coordinate delivery or pickup. BigBigBite does not prepare food — all items are prepared by the participating restaurant.

3. User Accounts

To place orders you may need to register an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

4. Orders and Payment

• All prices are displayed in U.S. Dollars (USD) and include any applicable Florida state sales tax
• Orders are subject to restaurant availability and operating hours
• Payment is processed securely at time of order through our payment processor (Stripe)
• You authorize BigBigBite to charge your selected payment method for the total order amount, including delivery fees and any tip selected
• Cancellations and refunds are subject to the individual restaurant policy and BigBigBite's discretion on a case-by-case basis

5. Delivery

• Estimated delivery times are provided as a courtesy and are not guaranteed
• You are responsible for providing a complete and accessible delivery address
• Delivery fees are calculated at checkout and displayed prior to order confirmation
• BigBigBite is not liable for delays resulting from traffic, weather, or other circumstances outside our control
• If no one is available to receive the order at the provided address, the order may be left at the door at the driver's discretion

6. Restaurant Responsibility

Restaurants listed on BigBigBite are independent businesses. Each restaurant is solely responsible for the quality, safety, preparation, and accuracy of their food items. BigBigBite makes no representations or warranties regarding food quality, allergen information, or compliance with health regulations. For allergen or dietary concerns, please contact the restaurant directly before ordering.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable federal or Florida law
• Place fraudulent, duplicate, or bad-faith orders
• Reverse-engineer, copy, scrape, or exploit any portion of the Platform
• Harass, threaten, or abuse restaurant staff or delivery drivers
• Attempt to gain unauthorized access to the Platform or its systems

8. Intellectual Property

All content, trademarks, logos, and software on the Platform are the property of BigBigBite or its licensors and are protected by U.S. intellectual property law. You may not reproduce, distribute, or create derivative works from any Platform content without prior written consent.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BigBigBite does not warrant that the Platform will be uninterrupted or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, BIGBIGBITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO FOOD QUALITY ISSUES, DELIVERY DELAYS, OR LOSS OF DATA. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida for resolution of any disputes arising under these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform with an updated date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
